Bonjour Pourquoi la culture des grèves est si répandue dans la société française et depuis longtemps ? Que dire les experts sur ce phénomène pas toujours signe positif des droits de l’homme ? quel est l’historique du grève dans le monde ? Merci beaucoup.

On note ainsi que l’exercice du droit de grève a souvent des répercussions sur une partie de la population étrangère au conflit justifiant l’emploi de ce mode de pression (par exemple, lors des grèves dans les transports publics).
De plus, la grève est l’expression d’un rapport de forces. Elle vise à faire céder l’employeur – qui peut être une entreprise privée ou l’État – en lui faisant subir un manque à gagner économique ou un préjudice en lien avec sa mission (ainsi, s’agissant de l’État, l’interruption de la continuité du Service public au détriment des usagers de ce service).
La grève demeure un rapport de forces qu’il est très difficile de canaliser juridiquement. Ainsi, l’occupation d’une entreprise à l’occasion d’une grève est une infraction. Le juge judiciaire, lorsqu’il est saisi d’une telle violation du droit de propriété et de la liberté de travailler des salariés non-grévistes, ordonne fréquemment l’évacuation de l’entreprise concernée. En ce qui concerne
« Contrairement à une idée répandue cependant, la baisse générale du nombre de jours de grève en France est une réalité. Les derniers chiffres connus issus de la Dares comptent 69 journées de travail non effectuées pour 1 000 personnes en 2015 contre 164 en 2005. […] L'institut de l'économie allemande IW (Institut der deutschenWirtschaft) fait tout de même la France la championne du monde des jours de grève avec 123 jours de grève pour 1 000 salariés en 2016. Les autres pays en tête du classement? Le Danemark (118), le Canada (87), la Belgique (87) et l'Espagne (79). A l'opposé, le Japon ne compterait que 0,2 jours, la Suisse, 1 jour et l'Autriche 2. […] Ces comparaisons sont toutefois à relativiser : les chiffres de tous les pays ne sont pas disponibles (par exemple en Italie et en Grèce) et certains pays comme les Etats-Unis ne recensent pas les mouvements de moins de 1 000 salariés. »
Relativisons en effet car les chiffres rapportés par Le Point donnent un tout autre classement :
« Si la France souffre d'une réputation d'éternels mécontents, prêts à manifester à la moindre occasion, elle n'est pourtant pas championne en la matière. En effet, Chypre est le pays qui a accumulé le plus de jours de grève en 2016. Sa moyenne ? 2 000 jours de grève pour 1 000 salariés. Le Danemark est deuxième avec 387 jours de grève pour 1 000 salariés. La France arrive 3e sur le podium, avec 80 jours de grève pour 1 000 salariés selon la dernière étude de l'Institut syndical européen. »
Enfin, dans une chronique d’Europe 1, la journaliste Géraldine Wdessner nuance également les résultats des études sur le sujet :
« La France est championne du monde de la grève. Vrai ou Faux ?
Cela semble plutôt faux, même si l’on ne peut pas apporter de réponse claire car cela dépend des années ; L'étude dont on parle ici [étude de la fondation allemande Hans Böckler en 2016] se base sur des statistiques officielles et des déclarations de syndicats, mais comme personne ne compte la même chose, rien n'est comparable : les chiffres de la France ne portent que sur le privé, l’Espagne exclue les grandes grèves générales, et Au Danemark, on ne compte pas les conflits qui provoquent moins de 100 jours de travail perdus ( une entreprise de 99 salariés en grève une journée ne sera pas comptée). On ne prend pas en compte, non plus, les débrayages d'une heure, de plus en plus courants... BREF : c'est le grand flou. Et selon les années, le podium évolue : la France est donnée championne sur la période 2005-2015, mais le même institut, en 2007-2016, place le Danemark en tête, et le Canada se place au premier rang dans les années récentes. »
Qu’en est-il du
« Aujourd’hui, 95 constitutions reconnaissent ouvertement le droit de grève. D’autres pays l’ont inscrit dans leur législation, parfois avec certaines limites. Des exceptions existent par exemple pour les services dits essentiels, comme la police, l’armée, le transport. Au total, plus de 140 Etats font mention de ce droit fondamental. Mais le droit de grève est de plus en plus menacé, et plusieurs pays cherchent à en limiter la portée […] Une poignée d’Etats n’autorise toujours pas la grève. Mais cela n’empêche pas certains salariés de mener des actions similaires. En général, ils n’attendent pas qu’on leur donne la permission pour déposer les outils ou manifester. C’est le cas dans certains pays du Golfe, où l’on trouve quelques entreprises qui ne s’opposent pas à la grève. Ou encore en Iran, où des actions régulières sont organisées, même si elles sont réprimées. Dans ces pays, la première étape va être de faire reconnaître la liberté syndicale des travailleurs et des travailleuses avant de pouvoir en arriver formellement au droit de grève. Et France Info précise :
« Au Japon, la plupart des grévistes préfèrent porter un brassard sur leur lieu de travail en signe de solidarité avec le mouvement. La culture du travail est fondamentale dans ce pays où une majorité de salariés de prennent pas les 20 jours de congés annuels auxquels ils ont droit. Pourtant, le Japon a connu des mouvements sociaux, notamment après la Seconde Guerre mondiale. Plus d’un million de Japonais étaient alors descendus dans la rue à l’appel du Parti communiste.
Dans certains pays, le droit de grève est menacé. En Grèce, qui a connu près de 50 grèves générales depuis 2010, le Parlement vient de voter une loi restreignant le droit de grève. Les grévistes doivent désormais avoir le soutien de 50% des membres des syndicats. Une restriction du droit de grève qui est dénoncée par syndicats et manifestants. Il existe encore une cinquantaine de pays où faire grève est interdit. C’est notamment le cas en Corée du Nord, au Qatar et en Arabie Saoudite. »

Pour compléter la réponse de nos collègues, voici quelques éléments historiques:
La grève, en tant que cessation d’activité comme moyen de contestation salariale, semble être un moyen de revendication fort ancien. Par exemple, le "Papyrus de la grève", conservé au musée Égyptien de Turin, relate un épisode de grève datant du règne de Ramsès III, aux environs de l’an 1152 avant notre ère. Les ouvriers travaillant à la construction du tombeau du pharaon avaient alors cessé leur travail, pour protester contre les retards de ravitaillement dont ils étaient victimes.
L’égyptologue Pierre Grandet a consacré une intervention à cet épisode, Les grèves de Deîr el-Médînéh, dans le cadre du colloque "Les régulations sociales dans l'antiquité".
Les actes de ce colloque sont également disponibles au format papier au silo moderne de la bibliothèque de la Part-Dieu.
Mais c'est surtout au XIXe siècle que ce moyen de contestation sociale se développera. Les évolutions de l’organisation du travail, avec le développement du salariat et l’apparition d’une classe ouvrière urbaine, conjuguées à des changements législatifs, avec le remplacement du délit de « coalition », par celui d’ « atteinte au libre exercice de l’industrie ou du travail », feront peu à peu de la grève un élément normal de la société industrielle.
Cette petite sélection vous permettra d’en savoir plus sur ce mode de contestation sociale depuis le XIXe siècle:
La grève en France : une histoire sociale XIXe-XXe siècle, de Stéphane Sirot, permet de saisir le contexte d’apparition de cette pratique, présente les différentes formes qu’a pu prendre la grève au cours de l’histoire, ainsi que la position des acteurs sociaux.
Les grandes luttes de la France ouvrière, d' Alain Rustenholtz, raconte les grandes grèves qui ont émaillé les XIXe et XXe siècles en France.
Les prolos, de Louis Oury, nous invite à suivre le parcours d’un jeune apprenti, issu du monde agricole, qui découvre l’univers ouvrier en tant que chaudronnier sur les chantiers navals de Saint Nazaire. L’auteur y raconte notamment de l’intérieur les grèves de 1955.
Ici notre défaite a commencé, coordonné par Mathilde Bertrand, Cornelius Crowley, Thierry Labica, revient sur la grève des mineurs britanniques de 1984-1985 contre un projet de fermeture de puits de mine. Cet évènement a profondément bouleversé le paysage social et politique du Royaume-Uni.
