Hier soir j'ai regardé "l'ombre d'un doute"à la télévision,il était question du vol des bijoux de la couronne de France...Le principal accusé était un dénommé "Miette",après son procès en cassation il fut acquitté!Pourquoi?

Il nous semble que lors de l’émission à laquelle vous faites référence (L’ombre d’un doute ), que vous avez suivie et que vous pourrez revoir ce dimanche, les historiens ont clairement exprimé leurs doutes et incertitudes concernant les véritables responsables du Vol des joyaux de la Couronne en septembre 1792.

Pour approfondir vos connaissances, nous vous recommandons la lecture de l’ouvrage de Bernard Morel,Les Joyaux de la couronne de France . Un chapitre entier intitulé « Le vol des joyaux de la couronne » traite de cet évènement. Voici un extrait : « « L’idée du vol des trésors du garde-meuble revient à un voleur renommé, Paul Miette. Né à Paris, âgé de 35 ans, il avait déjà été condamné pour vol en 1779 et en 1781 et avait été banni de Paris, à cette dernière date, pour 9 ans. Il fut arrêté à nouveau en 1790 mais relâché peu après. Dès le début de 1792, il venait chaque lundi, jour d’ouverture du garde-meuble au public, admirer « en visiteur » les richesses qu’il convoitait et put à loisir repérer les lieux et observer le manque de surveillance efficace. Arrêté en mars 1792 pour vol, , il fut condamné à plusieurs mois de prison et interné à La Force, où il exposa ses projets à d’autres détenus, tels que Deslandes, Tricot et Delors. Toute cette équipe fut délivrée lors des évènements des 2 et 3 septembre et décida le coup en enrôlant d’autres voleurs, dont certains furent appelés de province. »
Le casse réalisé, plusieurs des complices sont condamnés à mort car « L’acte d’accusation, outre le vol, retenait surtout « un complot à main armée, ayant pour but de renverser le gouvernement nouvellement constitué », ce qui entraînait la peine de mort. Le tribunal les poussa à avouer des relations avec des grands seigneurs, des princes, ou avec des personnages attachés à l’ancienne cour, ce qu’ils nièrent, bien entendu.» (p. 239).
(…) « Vint enfin, le 20 novembre, le procès de Paul Miette, l’instigateur du vol. Il avait été arrêté le 3 octobre à la suite des indications données par Douligny et Chambon lors de leur procès. Paul Miette avait déjà vendu sa part à des recéleurs et avait acheté pour 15 000 livres versées comptant une maison à Belleville. Il fut également condamné à mort mais se pourvut en cassation, les tribunaux de cassation ayant été créés courant novembre, ce que firent également les autres condamnés à mort bénéficiant d’un sursis provisoire, c’est à-dire Douligny, Chambon, Badarel, Depeyron dit Francisque, Gallois et Mauger. Le motif du pourvoi était basé sur le fait qu’ils étaient victimes d’une condamnation erronée : s’ils reconnaissaient le vol avec effraction, qui n’entraînait pas la peine de mort, tous niaient avec raison le complot à main armée contre l’Etat, accusation qui seule avait motivé les condamnations à mort. Le pourvoi fut accepté et la cour d’appel désignée fut celle de Beauvais qui jugea les sept hommes en mai-juin 1793. Paul Miette qui se défendit comme un beau diable et joua de toutes les contradictions du dossier et des dépositions, réussit à être acquitté alors qu’il était l’inventeur du vol ! (…) Ce jugement de Beauvais, qui reconnaissait définitivement le simple vol avec effraction, rejetant ainsi le complot politique avait été inconnu des historiens du XIXe siècle et ne fut mis en lumière que par Germain Bapst en 1889. »
